An Oklahoma man paid his handyman to kill his former son-in-law because he didn't like the way the man had been raising his daughter since his wife's death in March, the Oklahoma State Bureau of Investigation said Monday.

Gene Kirkpatrick, 63, of Jones, was arrested Monday on complaints of conspiracy to commit murder and conspiracy to commit burglary in the death of 49-year-old Fargo dentist Philip Gattuso, according to Oklahoma State Bureau of Investigation spokeswoman Jessica Brown. Gattuso had been married to Kirkpatrick's daughter, who died in March, and Kirkpatrick was unhappy with the way his grandchild was being raised, Brown said.

Brown said Kirkpatrick paid a handyman $3,000 and promised more if he would go to North Dakota and kill Gattuso.

Kirkpatrick was being held without bond in the Oklahoma County jail Monday night. The Oklahoma County Sheriff's Department did not know if he had an attorney yet.

The 41-year-old handyman, Michael Nakvinda, was arrested at his home in Oklahoma City over the weekend. In a court appearance there Monday, Nakvinda said he would not fight a return to North Dakota to face the charges.

Nakvinda is accused in court documents of killing Gattuso on Oct. 26 with a "hammer or other dangerous weapon," while trying to steal a Porsche convertible and electronic equipment from Gattuso's condominium. Gattuso's body was found in his home that night after he failed to pick up his 3-year-old daughter from day care.
